Ex Parte Communications

Contacting Mr. Hanna by only one of the parties to a dispute should be done consistently with best practices in international arbitration, which is to avoid contacts out of the presence of the other party or parties. Accordingly such ex parte contacts must be limited to requests of Mr. Hanna’s availability and absence of conflicts, the names and addresses of the parties, a general and limited description of the issues such as “a dispute arising out of a contract for the delivery of a [described] product or service” and questions generally of Mr. Hanna’s experience with a particular business sector.
